1. Acceptance of Terms

By creating an account, accessing Burn2Earn, joining a challenge, creating a challenge, making a payment, or using any related service, you agree to these Terms and Conditions and any policies referenced in them.

You must explicitly accept these Terms before joining a paid challenge. If you do not agree, you must not use Burn2Earn or join any challenge.

2. Eligibility

  • Burn2Earn is intended only for users who are at least 18 years old.
  • By using Burn2Earn, you confirm that you are 18 or older and legally able to enter into these Terms.
  • You are responsible for ensuring that your use of Burn2Earn, including paid fitness competitions and reward payouts, is legal in your country, state, province, or region.

3. Account Registration

Users may sign in using supported authentication methods, including Facebook, Google, or email and password. Users must provide accurate profile information, including name, email address, gender, date of birth, spoken language, and profile image where applicable.

You are responsible for maintaining the security of your account and for all activity that occurs under your account.

4. Nature of Burn2Earn Challenges

Burn2Earn provides skill-based fitness challenges where participants compete based on eligible activity data such as steps, running, and cycling. Burn2Earn is not intended to operate as gambling, betting, lottery, wagering, or a game of chance.

Challenge results are based on measurable fitness activity and the challenge rules displayed in the app.

5. Challenge Entry Fees and Prize Distribution

  • Users may be required to pay an entry fee to join a paid challenge.
  • Challenge entry fees are collected into a challenge pool.
  • Burn2Earn retains a 20% platform fee from the challenge pool.
  • The remaining 80% is distributed as follows: 50% to the first-place winner and 30% to the second-place winner.
  • All amounts are currently handled in USD unless otherwise stated in the app.

6. Minimum Participants and Challenge Start

A minimum of 3 participants is required for a challenge to start. If the minimum participant requirement is not met, the challenge may be cancelled and entry fees may be refunded to participants’ Burn2Earn wallets.

Burn2Earn may cancel or refund all participants where a challenge cannot reasonably proceed due to technical failure, platform error, fraud review, or other operational reasons.

7. No Refund After Joining

Once a user successfully joins a challenge, the entry fee is non-refundable except where Burn2Earn cancels the challenge, the challenge does not start because the minimum participant requirement is not met, or Burn2Earn determines that a refund is required due to a technical or operational issue.

8. Challenge Ranking and Winner Determination

Winners are ranked based on eligible activity records tracked by Burn2Earn and the activity completion time calculated from those records. Burn2Earn tracks activity at a per-minute level where supported by the app and connected health data sources.

A user who completes the goal first may still win even if their data is synced later, provided the data is synced within the permitted sync window and is accepted as eligible activity data.

If two or more users complete the goal at the same calculated completion time, the earlier synchronization time will be used as the tie-breaker. Burn2Earn may use additional deterministic tie-breakers where needed to finalize rankings fairly.

9. Sync Window and Result Announcement

Users must sync their progress within 6 hours after the challenge end time. Winner announcements are made after the 6-hour sync window closes.

Results are finalized after the 6-hour sync window, subject to fraud review or technical investigation.

10. Challenge Modification

Challenge goals, duration, entry fee, prize structure, and key rules cannot be modified after the first participant has joined the challenge.

Burn2Earn may reject, remove, suspend, or restrict challenges that are abusive, misleading, technically invalid, unlawful, unsafe, or inconsistent with platform policies.

11. Health Data and Permissions

Burn2Earn uses supported health data sources, including Health Connect and Apple Health, to track eligible fitness activity. If a user revokes or disables health permissions, challenge participation may be impacted and progress tracking may stop.

Users must not manipulate, falsify, automate, or submit fraudulent activity data.

12. Fair Play and Competition Integrity

  • Burn2Earn may investigate suspicious activity, manipulated activity, automated activity, fake progress, device tampering, duplicate accounts, payment abuse, or any conduct that affects fair competition.
  • Burn2Earn may delay, freeze, cancel, or withhold payouts during fraud review or technical investigation.
  • Users may be disqualified from a challenge if Burn2Earn determines that activity data is invalid, manipulated, fraudulent, or inconsistent with the challenge rules.
  • Funds may be frozen pending investigation where fraud, cheating, payment abuse, or policy violations are suspected.

13. Disputes

Users must submit result disputes within 48 hours after winner announcement by emailing support@metafycial.com. Burn2Earn aims to provide an initial response within 48 business hours.

Burn2Earn may review activity data, sync records, payment records, device records, logs, and other relevant information when handling disputes. Burn2Earn’s decision after review will be final unless required otherwise by applicable law.

14. Wallet and Withdrawals

Wallet balances remain available indefinitely while the account remains active and compliant with platform policies. Minimum withdrawal amounts, payout methods, and applicable fees may be displayed in the app at the time of withdrawal.

Payout requests are typically reviewed within 3-5 business days. Pending payout requests may be cancelled after 30 days of user inactivity where Burn2Earn requires additional information and the user does not respond.

15. Account Deletion

Account deletion is permanent and account recovery is not available after deletion.

Users cannot delete their account while they have a wallet balance greater than zero, are participating in an active challenge, or have a payout request under review.

After deletion, Burn2Earn may retain payment records, payout records, fraud/security records, legal records, and accounting records where required or permitted by law.

16. User Content and Conduct

Users may upload profile images, challenge banners, comments, replies, and other content where supported. Users are responsible for the content they submit.

Burn2Earn may remove content, suspend accounts, restrict features, or terminate access for harassment, offensive content, impersonation, spam, cheating, fraud, illegal activity, or policy violations.

17. Payments

Payments are processed through Stripe. Burn2Earn does not store full payment card details. Payment processing is subject to Stripe’s terms, policies, and availability.

18. Service Availability

Burn2Earn may update, suspend, limit, or discontinue features at any time. Burn2Earn is not responsible for delays, outages, sync failures, app store issues, health data provider issues, payment processor issues, or network failures outside its reasonable control.

19. Limitation of Liability

To the maximum extent permitted by law, Burn2Earn and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, loss of opportunity, or loss of expected rewards.

20. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles, unless mandatory local law requires otherwise.
